killing by misadventure

Accidental killing of a person where the slayer is doing a lawful act, unaccompanied by any criminal carelessness or reckless conduct. Excusable homicide occurring where one engaged in doing lawful act, without intention to do harm and, with proper precaution to avoid danger, unfortunately kills another.
